Bitstamp by Robinhood provides services to EU customers through Bitstamp Europe S.A., based in Luxembourg. 

The platform has received authorization from Luxembourg’s supervisory authority, the Commission de Surveillance du Secteur Financier (CSSF), as a Crypto-Asset Service Provider (CASP) under MiCA.

There is also a British Group company based in the United Kingdom. Due to the platform’s domicile, questions regarding the applicable legal system, the competent court and enforcement options in the event of foreign involvement may play a role.

Users often face lengthy, often non-transparent review processes and repeated requests for additional documents. Referrals to another responsible internal “department” without specifying of a time horizon, even after the submission of relevant documents, are not uncommon. 

Nevertheless, Bitstamp does not want to lose any customers either, but in particular wants to meet the complex regulatory requirements. 

However, if no remedial action is taken over a longer period of time, targeted communication with a lawyer can highlight the rights of the data subject and decisively strengthen its position in the environment of numerous support requests and legal audit requirements. 

To this end, the relevance of the concern must be made clear to the relevant departments within Bitstamp and, if necessary, to the responsible supervisory authorities in a factual but legally emphatic manner.
